Treatise on Maqasid al Shariah

Cloudy day. Am at my workplace rite now while waiting finish an hour break for lunch. After lunch, I should arrive at Town Hall for celebrating Chinese New Year. This is one of office matter that every one of us must attend. Hihi..

Just would like to share what have I read this morning while vetting the terminologies of Islamic Finance. This book grab my attention so much. Actually this book wrote in Arabic but it has been translating into English version. Ibn Ashur or his full name is Shaikh Muhammad al-Tahir Ibn Ashur, is the most prominent and renowed Zaytuna Imam and one of the great Islamic scholars of the 20th century... which is our era..

In this book, he proposed Maqasid as a methodology for the renewal of the thoery of the Islamic law, which undergone any serious development since the era of the great imams, starting with Shafi'ie in the second / 8th century and ending with al-Shatibi in 8th/14th century.

Ibn Ashur's methodology takes a centrist position between two contemporary extremes, namely 'neoliteralism' which ignores rationales and valid re-interpretations of Islam Islamic rulings for the sake of literal traditional views, and 'neorationalism, which ignores the religious and cultural identity of Muslims in its quest for 'modernization' and 'rationality'.

Maqasid of the Islamic law highlights rationales, proposes and common good in the Islamic rulings and stresses their importance, while basing itself on the Islamic scripts and observing the Islamic faith. A part that, the most important part that I found is that he proposed and addressed several sensitive topics of the intents / Maqasid of Nabi Muhammad s.a.w behind his actions and decisions. And there a lot of development theories introduced by him.

This book can help us in order to find out more issue which related to Islamic transactions (Mua'malat), especially on Islamic Finance. I like this book! But am not complete reading yet. hihi..
